1. Agreement to Terms

By accessing and using OpenFuse Service, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

OpenFuse provides a centralized circuit breaker and reliability control service for distributed systems. The Service includes APIs, SDKs, dashboards, and related documentation.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Transmit viruses or malicious code
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Use the Service to harm or exploit minors

5. Subscription and Billing

Subscription Plans

OpenFuse offers various subscription plans. By selecting a plan, you agree to pay the associated fees. Prices are subject to change with notice.

Payment Terms

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • You authorize us to charge your payment method on a recurring basis
  • Failure to pay may result in suspension or termination of service

Free Trial

If we offer a free trial, you may use the Service free of charge until the trial expires. After expiration, you must subscribe to continue using the Service.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by OpenFuse and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to your data. By using the Service, you grant us a license to use your data solely to provide the Service to you.

7. Service Level Agreement

We strive to maintain high availability of the Service. Specific uptime guarantees and remedies are outlined in our Service Level Agreement, available for Business and Enterprise plans.

8. Data Protection

We process your data in accordance with our Privacy Policy. By using the Service, you consent to such processing and warrant that all data provided is accurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENFUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless OpenFuse from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Export Controls

You agree to comply with all applicable export and import laws and regulations, including U.S. export controls and economic sanctions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes at least 30 days before they take effect.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
